Last updated: September 16, 2026

These Terms of Service (“Terms”) govern your access to and use of the website located at themedadvantage.com (the “Site”), which is operated by MedAdvantage (“Company,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. We grant you a limited, revocable, nonexclusive, and nontransferable right to access and use the Site for your personal or internal business purposes.

You are responsible for ensuring that your use of the Site complies with all laws and regulations applicable to you.

2. Educational Information and No Professional Advice

The Site may provide general information about Individual Coverage Health Reimbursement Arrangements (“ICHRAs”), health reimbursement arrangements, employee benefits, health coverage, taxes, compliance, and related topics.

This information is provided for general educational and informational purposes only. It is not intended to constitute legal, tax, accounting, medical, insurance, investment, financial, or other professional advice. You should consult appropriately qualified professionals regarding your specific circumstances before making benefits, insurance, tax, legal, medical, or financial decisions.

Laws, regulations, government guidance, insurance products, carrier requirements, plan availability, premiums, eligibility requirements, and tax treatment may change and may vary based on individual circumstances and location. We do not guarantee that information on the Site is complete, current, accurate, or applicable to your situation.

Your use of the Site or communication with us through the Site does not, by itself, create an attorney-client, accountant-client, insurance broker-client, fiduciary, advisory, or other professional relationship. Any services provided by MedAdvantage may be subject to a separate written agreement.

3. No Insurance Coverage or Benefit Plan Established

Nothing on the Site, by itself, constitutes:

a. A binding offer, insurance quote, binder, policy, or contract of insurance.

b. A guarantee that insurance coverage will be issued, renewed, or remain available.

c. A guarantee that any person or organization is eligible for an ICHRA, reimbursement, tax benefit, insurance product, or other benefit.

d. The establishment, amendment, administration, or adoption of an employee benefit plan.

e. A guarantee of compliance with any federal, state, or local law.

Any insurance coverage, benefit arrangement, reimbursement obligation, or service relationship will be governed by the applicable written agreements, plan documents, insurance policies, carrier materials, and legal requirements. If information on the Site conflicts with an applicable policy, plan document, service agreement, or other governing document, the governing document will control.

4. Separate Agreements and Services

Certain products or services offered by or through MedAdvantage may be governed by additional terms, proposals, service agreements, engagement letters, plan documents, carrier requirements, or other written agreements.

If these Terms conflict with a separate written agreement governing a specific product or service, the separate written agreement will control with respect to that product or service.

5. Prohibited Uses

You agree that you will not use the Site to:

a. Violate any applicable federal, state, local, or international law or regulation.

k. Attempt to obtain information or materials through methods that are not intentionally made available through the Site.

6. Information and Materials You Submit

If you submit information through a form, email, or other communication method made available through the Site, you represent that the information is accurate and that you have the right and authority to provide it.

You may not submit information or materials that are unlawful, fraudulent, threatening, defamatory, obscene, infringing, misleading, or harmful.

Do not submit sensitive health, medical, financial, or identification information through a general website form or unsecured email unless we have expressly directed you to submit that information through an approved and appropriately secured method.

Any feedback, comments, suggestions, or ideas you voluntarily provide regarding the Site or our services may be used by us without restriction or compensation to you, provided that our use remains subject to our Privacy Policy and applicable law.

8. Third-Party Websites and Services

The Site may contain links to websites, products, applications, tools, or services operated by third parties. These links are provided for convenience and informational purposes only.

We do not control and are not responsible for the availability, accuracy, security, privacy practices, content, products, services, or conduct of third-party websites or service providers. The inclusion of a link does not necessarily imply that MedAdvantage endorses, sponsors, or is affiliated with the third party.

Your use of a third-party website or service is governed by that third party’s terms and privacy practices. You access third-party websites and services at your own risk.

9. Site Availability and Changes

We may update, modify, suspend, restrict, or discontinue all or any portion of the Site at any time and without prior notice. We do not guarantee that the Site or any content will always be available, uninterrupted, secure, complete, or free from errors.

We may correct errors, inaccuracies, or omissions and update Site content at any time. We are not obligated to update information on the Site unless required by law.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, FUNCTIONS, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND.

MEDADVANTAGE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, these exclusions will apply only to the maximum extent permitted by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDADVANTAGE AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES DAMAGES ARISING FROM OR RELATING TO LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, USE, DATA, COVERAGE, BENEFITS, OR OTHER INTANGIBLE LOSSES, WHETHER ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, YOUR RELIANCE ON SITE CONTENT, THIRD-PARTY CONTENT OR SERVICES, UNAUTHORIZED ACCESS, SECURITY INCIDENTS, OR ANY OTHER MATTER RELATING TO THE SITE.

These limitations apply regardless of the legal theory asserted and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MedAdvantage and its owners, affiliates, officers, directors, employees, contractors, representatives, agents, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related obligations.

15. Changes to These Terms

We may update these Terms periodically to reflect changes in the Site, our services, our business practices, or applicable legal and regulatory requirements.

Updated Terms will be posted on this page with a revised “Last updated” date. Unless otherwise stated, updated Terms become effective when posted. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms.

16. Severability and Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed from these Terms. The remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or our right to enforce it later.
